Public Participation Opportunities

Permits subject to public review (APA Permits) go through several steps during the permitting process. The first step is the opportunity for concerned citizens to request an Informational Meeting, which would be held early in the permit application review, prior to an in-depth technical review. It provides the public an occasion to learn about proposed projects and ask questions of the applicant. The second opportunity to take part in the permit issuance process for Permits to Construct is during the Comments and Public Hearing stage, which is offered once the Department has reached a tentative determination. At this time, concerned citizens may submit written comments or request a Public Hearing to offer public comments that will be considered by the Department when rendering a Final Determination whether or issue or deny the permit.

Alternate Public Review Procedures for Certain Sources Subject to New Source Performance Standards (NSPS) Sources

House Bill 95, which took effect on October 1, 2013, established an alternate public review procedure for sources subject to public review only because they trigger EPA's New Source Performance Standards (NSPS). Examples include: engines that are not emergency generators, small combined heat and power facilities, peak shavers, and boilers less than 50 MMbtu/hr that are not covered under an Air Quality General Permit to Construct.

Final Determinations for APA Permits to Construct

The last part of the permit issuance process for APA construction permits is when the Department reaches a final determination on the issuance of a permit. If the Department determines that a proposed permit can be issued, Citizens have 30 days from the issuance of the permit to object.
