AIR AND RADIATION MANAGEMENT ADMINISTRATION

Advanced Radiology – Anne Arundel County - On March 1, MDE issued a Complaint and Penalty in the amount of $2,300 to Advanced Radiology, P.A. for violations of regulations governing the possession and use of radioactive material. An employee of the licensee self-administered radioactive material without prior approval, which in turn prevented Advanced Radiology from conducting required surveys of incoming packages of radioactive material. Status: Advanced Radiology has 30 days to request a hearing. (Reference #RHP 06-05)

Applied Technical Services – Reciprocal Licensee - On March 13, MDE issued a Complaint and Penalty in the amount of $9,250 to Applied Technical Services, Inc. for violations of regulations governing the possession and use of radioactive material. While working in Maryland, this Virginia-based firm violated a number of Maryland regulations, including failure to have an operable survey meter at its worksite, and failure to post radiation caution signs, among other violations. Status: Applied Technical Services has 30 days to request a hearing. (Reference #RHP 06-10) 

WASTE MANAGEMENT ADMINISTRATION

Bayview Holdings, LLC et al, Baltimore City – 70 affected properties – On February 20, MDE signed a Settlement Agreement and Consent Order with Bayview Holdings, LLC et al containing a penalty equaling $10,000 for violation of Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. The agreement includes provisions to obtain risk reduction certificates, and perform supplemental environmental projects involving the replacement of windows containing lead paint. Status – The penalty has been paid. (Case Number 2006-30-8778)

Andrew J. Burns, III et al, Baltimore City – 14 affected properties – On February 20, MDE signed a Settlement Agreement and Consent Order with Andrew J. Burns, III et al containing a penalty equaling $5,000 for violating Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. The agreement includes provisions to obtain risk reduction certificates. Status – The penalty has been paid. (Cases Number 2006-30-9431)

James and Martha Ikegwu, Baltimore City – 3 affected properties - On February 21, MDE issued an Administrative Complaint, Order and Penalty equaling $55,000 to James and Martha Ikegwu for violating Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – James and Martha Ikegwu have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9795)

Elizabeth Bloor and Bloor Holding Co., Talbot and Caroline Counties – 17 affected properties – On February 22, MDE issued an Administrative Complaint, Order and Penalty equaling $13,700 to Elizabeth Bloor and Bloor Holding Co. for violating Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – Elizabeth Bloor and Bloor Holding Co. have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-05-9063)

Eugene and Dorothy Sugar, Baltimore City – 7 affected properties – On February 22, MDE issued an Administrative Complaint, Order and Penalty equaling $44,000 to Eugene and Dorothy Sugar for violation of Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – Eugene and Dorothy Sugar have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9139)

Robert and Geraldine White, Baltimore City – 5 affected properties – On February 22, MDE issued an Administrative Complaint, Order and Penalty equaling $45,500 to Robert and Geraldine White for violation of Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – Robert and Geraldine White have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9328)

Francis J. and Emma Lou Parisan, Cecil County – 5 affected properties – On February 27, MDE issued an Administrative Complaint, Order and Penalty equaling $33,800 to Francis J. and Emma Lou Parisan for violation of Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – Francis J. and Emma Lou Parisan have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-07-8925)

John and Sylvia Wood, Caroline County – 5 affected properties – On March 6, MDE issued an Administrative Complaint, Order and Penalty equaling $20,000 to John and Sylvia Wood for violation of Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – John and Sylvia Wood have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-05-8862)

Norino Properties and Balsamo & Norino Properties, Baltimore City – 25 affected properties – On March 6, MDE issued an Administrative Complaint, Order and Penalty equaling $60,000 to Norino Properties and $30,000 to Balsamo & Norino Properties for violation of Maryland’s Lead Laws by failing to bring the affected properties into compliance with risk reduction standards. Status – Norino Properties and Balsamo & Norino Properties have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9587)

Louise and Robert Parker and Celeste Simmons, Baltimore City – 8 affected properties – On March 6, MDE issued an Administrative Complaint, Order and Penalty equaling $32,500 to Louise and Robert Parker and Celeste Simmons for violation of Maryland’s Lead Laws by failing to bring the affected properties into compliance with risk reduction standards. Status – Louise and Robert Parker and Celeste Simmons have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9826)

James and Janice Shehan, Anne Arundel & Carroll Counties & Baltimore City – 4 affected properties – On March 6, MDE issued an Administrative Complaint, Order and Penalty equaling $35,000 to James and Janice Shehan for violation of Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – James and Janice Shehan have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-06-9451)

Mark and Margaret Callahan, Queen Anne’s County – 2 affected properties – On March 6, MDE issued an Administrative Complaint, Order and Penalty equaling $19,700 to Mark and Margaret Callahan for violation of Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – Mark and Margaret Callahan have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-17-9161)

C. Murrell Business Consultant, Inc., Baltimore City – 52 affected properties – On March 7, MDE signed a Consent Decree with Cephus M. Murrell representing himself and on behalf of C. Murrell Business Consultant, Inc. The Consent Decree contained a Penalty equaling $20,000 for violation of Maryland’s Lead Laws, and requires that lead risk reduction work, including replacement of all windows containing lead based paint, be performed at all the occupied non-compliant properties. Status – The penalty has been paid. (Case Number 24-C-06-010036)

WATER MANAGEMENT ADMINISTRATION

Maryland Environmental Service, Frederick County – On March 12, 2007, MDE and the Maryland Environmental Service (MES), finalized an administrative consent order regarding improvements to the I-70 Rest Stop wastewater treatment plant located in Myersville. MES is the contract operator for the facility owned by the State Highway Administration (SHA) and holds the NPDES permit for the wastewater treatment plant. Under the terms of the consent order, MES has agreed to temporarily cease discharges from the plant beginning on or before April 30, 2008 in conjunction with a planned upgrade of the facility by SHA. In settlement of effluent limitation violations that have occurred during the period October 1 – November 30, 2006, MES has agreed to pay $2,000. MES has further agreed to pay stipulated penalties for additional violations that have or may occur since December 1, 2006 until such time as the plant is taken out of service. Status: Case closed. (Reference #CO-07-0458).

Calvert County Commissioners, Calvert County – On February 22, 2007, MDE and the Calvert County Commissioners finalized an administrative consent order regarding improvements to the Marley Run Wastewater Treatment Plant. Under the terms of the consent order, Calvert County has agreed to implement an activated sludge pilot test within 180 days to evaluate an alternative biological treatment process. Following implementation of the study, the county is required under the consent order to submit a plan and schedule to MDE for review and approval for corrective actions at the wastewater treatment plant that will allow the plant to consistently meet NPDES discharge permit effluent limitations. The County has also agreed to pay stipulated penalties for violations of the consent order and established permit limits and interim effluent performance standards during the pendency of the consent order. Status: Case closed. (Reference #CO-07-0443).

Water and Sediment Pollution Penalties – Statewide
During the period February 14, 2007 to March 15, 2007, MDE collected an additional $11,050 to the Maryland Clean Water Fund in resolution of alleged water pollution violations from six facilities and $7,650 to the Maryland Sediment Fund in resolution of alleged sediment control and sediment pollution violations from one site.
