The Water and Science Administration is reviewing requests for a State Water Quality Certification 22-WQC-0021 and 25-WQC-0022, and a Coastal Zone Consistency Determination concurrence from the U.S. Army Corps of Engineers Baltimore and Philadelphia Districts to reissue 56 existing Nationwide Permits (NWPs) and issue one new NWP. One NWP is not proposed for reissuance. Pursuant to COMAR 26.08.02, Regulation .10 Water Quality Certification, and 15 C.F.R. Section 930.42 Subpart C of the Coastal Zone Management Act, the Maryland Department of the Environment is required to give public notice of this application. Section 401 of the Clean Water Act requires the State of Maryland to issue a Water Quality Certification (WQC) for any federally permitted project which may result in the discharge of dredged or fill material to navigable waters, as long as the permitted activity will comply with Maryland’s water quality standards. The purpose of the consistency determination is to advise the federal agency as to whether the federal activity will be consistent with Maryland's Enforceable Policies approved under Maryland’s Coastal Zone Management Program.
NWPs are general permits issued on a nationwide basis to streamline the authorization of activities that result in for discharges of dredged or fill material into Waters of the United States with no more than minimal individual and cumulative adverse environmental effects. Many of the proposed NWPs require notification to the District Engineer before commencing those activities, to ensure that the activities authorized by those NWPs cause no more than minimal individual and cumulative adverse environmental effects.
