:: Enforcement and Compliance Notes for Mid-November 2006 to Mid-December 2006

AIR AND RADIATION MANAGEMENT ADMINISTRATION

Mettiki Coal Corporation, Garrett County - On November 29, MDE issued an Opportunity to Settle letter to the Mettiki Coal Corporation. The action addresses air pollution violations that occurred at their Oakland facility when Mettiki’s thermal coal dryer failed a sulfur dioxide stack test. An Opportunity to Settle letter provides the facility with an opportunity to discuss and settle the violations with MDE before enforcement action is initiated. MDE has taken previous enforcement actions against Mettiki for similar violations. Status: Mettiki has 20 days to respond to MDE. (Reference #AQCP 061129)

WASTE MANAGEMENT ADMINISTRATION

Rodney Johnson, Baltimore City – 4 affected properties – On November 15, MDE issued an Administrative Complaint, Order and Penalty equaling $55,000 to Rodney Johnson for violation of Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – Rodney Johnson has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9536)

John A. McCray and Rocksann L. McCray, Baltimore City – 8 affected properties – On November 15, MDE issued an Administrative Complaint, Order and Penalty equaling $11,000 to John A. McCray and Rocksann L. McCray for violating Maryland’s Lead Laws by failing to register their properties and failing to bring the affected properties into compliance with risk reduction standards. Status – John A. McCray and Rocksann L. McCray have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Cases Number 2006-30-9472)

Tyler Towing, et al, Howard County - On November 20, MDE entered into a settlement agreement with Tyler Towing, et al, which contained a penalty equaling $22,000 for violations of Maryland scrap tire disposal laws. Status – A lien has been placed on the property, and the penalty will be paid when the property is sold. (Howard County Circuit Court Case Number 13-C-05-062085OC)

Terraine Saunders, Baltimore City – 27 affected properties – On November 21, MDE issued an Administrative Complaint, Order and Penalty equaling $44,000 to Terraine Saunders for violating Maryland’s Lead Laws by failing to bring the affected properties into compliance with risk reduction standards. Status – Terraine Saunders has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9588)

Melissa Russell-Martz and Paul W. Russell, Baltimore City – 1 affected property – On December 6, MDE issued an Administrative Complaint, Order and Penalty equaling $53,650 to Melissa Russell-Martz and Paul W. Russell for violating Maryland’s Lead Laws by failing to register their property and failure to bring the affected property into compliance with risk reduction standards. Status – Melissa Russell-Martz and Paul W. Russell have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9257)

Eddie Traver, III, Baltimore City – 1 affected property – On December 7, MDE issued an Administrative Complaint, Order and Penalty equaling $27,500 to Eddie Traver for violating Maryland’s Lead Laws by failing to register his property and failure to bring the affected property into compliance with risk reduction standards. Status - Eddie Traver has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9591)

Gregory E. Hay, Sr., Baltimore City – 7 affected rental units - On December 11, MDE entered into a settlement agreement with Gregory E. Hay, Sr. that contained a penalty equaling $5,000 for violations of Maryland’s Lead Laws by failing to bring the affected properties into compliance with risk reduction standards. Status – The penalty has been paid. (Case Number 2006-30-8982)

Anthony E. Balcerzak, Sr. and Patricia E. Balcerzak, Baltimore City – 7 affected properties - On December 11, MDE entered into a settlement agreement with Anthony E. Balcerzak, Sr. and Patricia E. Balcerzak that contained a penalty equaling $5,000 for violations of Maryland’s Lead Laws by failing to bring the affected properties into compliance with risk reduction standards. Status – The penalty has been paid. (Case Number 2006-30-9010)

WATER MANAGEMENT ADMINISTRATION

JCR Enterprises, Inc., Dorchester County – On December 5, 2006, MDE and JCR Enterprises, Inc. (“JCR”) finalized a Settlement Agreement that resolved MDE’s civil suit filed in the Circuit Court for Dorchester County regarding alleged water pollution violations at the JCR facility in August of 2005. Under the terms of the Settlement Agreement, JCR has agreed to pay $10,000 to the Maryland Clean Water Fund to resolve all alleged water pollution violations during the period January 2005 through August 2006 and to expend at least $15,000 to perform a supplemental environmental project (SEP) involving modification of its existing storm water management pond. Status: Case closed. (Reference Case No. 09-C-06-14139)

The City of Salisbury, Wicomico County – On November 26, 2006, MDE and the City of Salisbury finalized an administrative consent order resolving MDE’s Administrative Complaint, Order and Penalty filed on May 19, 2006 for alleged unlawful discharges of sewage sludge at the Salisbury Wastewater Treatment Plant. Under the terms of the consent order, Salisbury is required to remove all sludge from its lagoon by no later than July 20, 2007 and pay a penalty of $10,000 to the Maryland Clean Water Fund. Status: Case closed. (Reference Case No. MDE-WMA-067-26681)
 
Town of Indian Head, Charles County - On December 11, 2006, MDE and the Town of Indian Head finalized an administrative consent order regarding improvements to the Town of Indian Head Wastewater Treatment Plant. Under the terms of the consent order, Indian Head is required to implement an enhanced nutrient removal (ENR) upgrade of its plant by no later December 31, 2008. Status: Case closed. (Reference Case No. CO-07-0388)
 
Water and Sediment Pollution Penalties – Statewide
During the period November 15, 2006 to December 14, 2006, MDE collected an additional $34,950 to the Maryland Clean Water Fund in resolution of alleged water pollution violations from three facilities and $22,740 to the Maryland Sediment Fund in resolution of alleged sediment control and sediment pollution violations from four sites.
