:: Enforcement and Compliance Notes for Mid-September to Mid-October 2006

Air and Management Administration

Perdue – Wicomico County – On September 19, MDE issued a Notice of Proposed Civil Penalty in the amount of $20,500 to Perdue’s Salisbury plant for failure to comply with several requirements contained in their air quality operating permit, including submission of timely reports, monitoring, and record keeping. The violations have since been corrected. The plant includes various processes with air emissions; including grain handling, feed mill, vegetable oil refinery and extraction operations. Status: Perdue has 10 days to request a meeting on the penalty. (Reference # ACP 06-08)

Namco Market – Prince George’s County – On September 19, MDE received payment in the amount of $2,200 from Namco Market for violations of vapor recovery requirements for their gasoline pumps. Violations included failure to test, failure to provide test results, failure to train workers, failure to keep records, and failure to post signs. The violations have since been corrected. Status: Case Closed. (Reference # ACP 05-09A)

Ray Miller Open Burning Case – Garrett County – On October 5, MDE issued a Notice of Proposed Civil Penalty in the amount of $500 to Mr. Ray Miller for violations of open burning regulations. MDE is working with the Garrett County Health Department on this case. The Open Burning Program is administered by the counties, with MDE providing backup support and enforcement as needed. In this case, Garrett County responded to a complaint regarding open burning on a farm. Upon investigation, the County determined that the farm owner was burning without a permit and was burning materials that created dense smoke and a nuisance, violating open burning requirements. The County had also previously notified the farmer that he was not allowed to burn the materials. Status: Ray Miller has 10 days to request a meeting on the penalty. (Reference # ACP 06-06)

ISG Sparrows Point (aka Mittal Steel) (formerly Bethlehem Steel) – Baltimore County – On October 6, MDE signed a Consent Order with ISG to settle air pollution violations at their Sparrows Point plant. The violations include Volatile Organic Compound emissions exceedances at the sinter plant and monitoring and recordkeeping violations of their air quality permit. The settlement includes corrective actions to address the violations, a $50,000 penalty, and a $25,000 SEP. The SEP portion of the penalty will go towards the installation of electrical outlets at Baltimore City Schools so that the University of Maryland’s Breathmobile can access the outlets. Status: Case Closed. (Reference #AQCP 061006)

Water Management Administration

Meadowview Wastewater Treatment Plant – Cecil County – On Sept 19, 2006, Cecil County paid a mandatory penalty of $10,000 to the Maryland Clean Water Fund in resolution of total suspended solids effluent violations at the Meadowview Wastewater Treatment Plant, located in Elkton, Maryland, that occurred in May and October 2005. Status: Case closed. (Reference #PS-07-0342).

New Earth Services, Inc. et al. – Dorchester County – On September 29, 2006, MDE filed in the Circuit Court for Dorchester County an Amended Complaint for Civil Penalties and Injunctive Relief against defendants New Earth Services, Inc. (NES) and Dorchester County. The action seeks a $70,000 civil penalty against NES for water pollution violations during the period October 6, 2005 through January 31, 2006 at its former composting site located on Galligher Farm Road in Hurlock, Maryland. The action also requires that Dorchester County comply with MDE’s July 27, 2005 administrative order for clean up of the site. Status: Case closed. (Reference Case No. 09-C-05-013785).

Guthmann’s Elite Manufacturing Systems, Inc. (GEMS) – Baltimore City – On September 18, 2006, MDE’s Water Management Administration and Waste Management Administration finalized an administrative consent order with GEMS resolving the administrative Complaint, Order and Penalty filed on September 15, 2005 for oil and water pollution violations at GEMS’ metal pole fluting facility located on 2825 Annapolis Road in Baltimore. Under the terms of the consent order, GEMS is required to pay $10,000 to the Maryland Clean Water Fund and to implement various requirements and corrective actions at the property to comply with the facility’s state discharge permit and to address mitigation of potential oil contamination. Status: Case closed. (Reference #WMA-SA-07-0383).

Water and Sediment Pollution Penalties – Statewide – During the period September 15, 2006 to October 15, 2006, MDE collected an additional $6,100 to the Maryland Clean Water Fund in resolution of alleged water pollution violations from three facilities and $8,700 to the Maryland Sediment Fund in resolution of alleged sediment control and sediment pollution violations from three sites.

Waste Management Administration

Southwestern Investments, et al. – Baltimore City – 12 affected properties – On September 15, MDE signed a Settlement Agreement and Consent Order with Southwestern Investments, et al concerning violation of Maryland’s Lead Laws by failing to register properties, and failure to bring the affected properties into compliance with risk reduction standards. The settlement contained a $9,250 penalty, and required certain lead abatement work to be performed. Status – $5,250 has been paid, and the remainder will be paid in 4 monthly installments. (Case Number 2006-30-9225)

Philip Rossetti and Inspection Services Association – Baltimore City – 5 affected properties – On September 18, MDE issued an Administrative Complaint, Order and Penalty equaling $5,000 to Philip Rossetti and Inspection Services Association for violating Maryland’s Lead Laws by issuing false passing lead risk reduction certificates. The Order revoked the Visual Inspector accreditation of Philip Rossetti and Inspection Services Association. Status – Philip Rossetti and Inspection Services Association have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Cases Number 2006-30-9084)

Cornelio McDonald – Baltimore City – 2 affected properties – On September 18, MDE issued an Administrative Complaint, Order and Penalty equaling $22,000 to Cornelio McDonald for violating Maryland’s Lead Laws by failing to register his properties and failing to bring the affected property into compliance with risk reduction standards. Status – Cornelio McDonald has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-8832)

Hakim Nadiff – Baltimore City – 4 affected properties – On September 18, MDE issued an Administrative Complaint, Order and Penalty equaling $13,500 to Hakim Nadiff for violating Maryland’s Lead Laws by failing to register his properties and failing to bring the affected property into compliance with risk reduction standards. Status – Hakim Nadiff has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Cases Number 2006-30-9437)

Educational Capitol Trust Foundation, et al. – Baltimore City – 34 affected properties - On September 22, MDE issued a Second Amended Administrative Complaint, Order and Penalty equaling $100,000 to Educational Capitol Trust Foundation, et al for violating Maryland’s Lead Laws by failing to register their properties and failing to bring the affected properties into compliance with risk reduction standards.. Status – Educational Capitol Trust Foundation has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2003-30-6122)

Bakervale, LLC et al. – Baltimore City – 10 affected properties – On September 28, MDE entered into a Settlement Agreement and Consent Order with Bakervale, LLC et al that requires Bakervale, LLC et al to pay a penalty 0f $5,000 to MDE, and meet other requirements of Maryland laws and regulations governing the reduction of lead paint hazards in pre-1950 residential rental dwelling property units. Status – Bakervale, LLC et al has paid the first $500 of the required penalty. (Case Number 2005-30-8116)

Martin Mintz – Baltimore City – 1 affected property – On Septembet 25, MDE issued an Administrative Complaint, Order and Penalty equaling $27,500 to Martin Mintz for violating Maryland’s Lead Laws by failing to register his property, and failure to bring the affected property into compliance with risk reduction standards. Status – Martin Mintz has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9427)

Anthony and Adanna Onyewuchi – Baltimore City – 3 affected properties – On September 25, MDE issued an Administrative Complaint, Order and Penalty equaling $21,000 to Anthony and Adanna Onyewuchi for violating Maryland’s Lead Laws by failing to renew property registrations and failure to bring the affected properties into compliance with risk reduction standards. Status – Anthony and Adanna Onyewuchi have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9381)

Glen Crotts and Largo 1st Trust, LLC – Baltimore City – 2 affected properties – On September27, MDE issued an Administrative Complaint, Order and Penalty equaling $20,000 to Glen Crotts and Largo 1st Trust, LLC for violating Maryland’s Lead Laws by failing to bring the affected properties into compliance with risk reduction standards. Status – Glen Crotts and Largo 1st Trust, LLC have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9608)

Isaac W. and Gail R. Monk – Baltimore City – 2 affected properties – On October 5, MDE issued an Administrative Complaint, Order and Penalty equaling $13,750 to Isaac W. and Gail R. Monk for violating Maryland’s Lead Laws by failing to register their properties, and failure to bring affected properties into compliance with risk reduction standards. Status – Isaac W. and Gail R. Monk have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9495)

Robert and Geraldine White – Baltimore City – 5 affected properties – On October 5, MDE issued an Administrative Complaint, Order and Penalty equaling $43,000 to Robert and Geraldine White for violating Maryland’s Lead Laws by failing to register their properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – Robert and Geraldine White have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9328)

Michael McMannis –Baltimore City – 1 affected property – On October 5, MDE issued an Administrative Complaint, Order and Penalty equaling $38,000 to Michael McMannis for violating Maryland’s Lead Laws by failing to register the affected property, and failure to bring the affected property into compliance with risk reduction standards. Status – Michael McMannis has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9722)

Olayemi Jummy Kilo – Baltimore City – 4 affected properties – On October 5, MDE issued an Administrative Complaint, Order and Penalty equaling $16,500 to Olayemi Jummy Kilo for violating Maryland’s Lead Laws by failing to register the affected properties, and failure to bring the affected properties into compliance with risk reduction standards. Status – Olayemi Jummy Kilo has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9479)

Ruth Mayo – Baltimore City – 12 affected properties – On October 5, MDE entered into a Settlement Agreement and Consent Order with Ruth Mayo. The agreement contains a penalty equaling $6,000 for prior violations of Maryland’s Lead Laws, and requires Ruth Mayo to ensure that all properties are either vacated or brought into compliance with lead risk reduction standards. Status – The penalty has been paid. (Case Number 2006-30-9302)

H. Tolbert Williamson and Williamson Properties, LLC – Caroline County – 24 affected properties – On October 5, MDE entered into a Settlement Agreement and Consent Order with H. Tolbert Williamson and Williamson Properties. The agreement contains a penalty equaling $8,000 for prior violations of Maryland’s Lead Laws, and requires H. Tolbert Williamson and Williamson Properties to ensure that all properties are brought into compliance with lead risk reduction standards. Status – $4,000 has been paid. (Case Number 2005-05-8264)

William and Regina Bonnett – Baltimore City – 6 affected properties – On October 10, MDE issued an Administrative Complaint, Order and Penalty equaling $45,000 to William and Regina Bonnett for violating Maryland’s Lead Laws by failing to bring the affected properties into compliance with risk reduction standards. Status – William and Regina Bonnett have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-8686)

Fallston Service Center, Inc. – Harford County – On October 10, MDE issued a Complaint, Order and Administrative Penalty equaling $40,000 to Fallston Service Center, Inc. for the discharge of petroleum products and failure to investigate and remove the release. As a result of the release MTBE, a gasoline compound has impacted a near by water supply well. The order associated with the complaint requires investigation and cleanup of the release. Status – Fallston Service Center, Inc. has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number OCP-9-0816-HA)

Gemcraft Homes Forest Hill LLC – Baltimore County – On October 5, MDE issued a Complaint, Order and Administrative Penalty equaling $25,000 to Gemcraft Homes Forest Hill LLC for violation of Maryland law and regulations regarding Controlled Hazardous Substances. The complaint relates to the improper storage and disposal of hazardous wastes at the former Country Plant Store. The order associated with the complaint requires an assessment of the nature and extent of any contamination from the mismanagement of waste materials at the site, and immediate implementation of proper procedures for the management of hazardous wastes. Status – Gemcraft Homes Forest Hill LLC has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number C-O-07-007)

Defense Reutilization and Marketing Service, Tri State Government Services, Inc. and EcoFlo – Charles County – On October 13, MDE issued an Complaint and Administrative Penalty equaling $75,000 to Defense Reutilization and Marketing Service, Tri State Government Services, Inc. and EcoFlo for violation of Maryland law and regulations regarding Controlled Hazardous Substances. These companies were involved in the disposal of 20 30-gallon drums of Trinitromethane from the Naval Surface Warfare Center at Indian Head. Six of the drums were not properly packaged for transportation to a hazardous waste disposal site. As a result, an incident involving the release of some of the contents of the drums occurred on northbound Interstate Highway 83 near Parkton, Maryland. Status – Defense Reutilization and Marketing Service, Tri State Government Services, Inc. and EcoFlo have 10 days to request a hearing on the Complaint and 30 days to request a hearing on the Penalty. (Case Number CO-07-001)

Lafayette and Geneva Harris – Baltimore City – 5 affected properties – On October 10, MDE issued an Administrative Complaint, Order and Penalty equaling $35,000 to Lafayette and Geneva Harris for violating Maryland’s Lead Laws by failing to bring the affected properties into compliance with risk reduction standards. Status – Lafayette and Geneva Harris have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 2006-30-9288)
