The Johns Hopkins Health System, Baltimore City – On September 8, MDE issued a Complaint, Order, and Administrative Penalty in the amount of $10,000 to The Johns Hopkins Health System for a radiation misadministration. Johns Hopkins allowed a patient to be treated with radiation therapy in the wrong treatment area for a five-day period. Status: Johns Hopkins Health System has 10 days to request a hearing on the Order and 30 days to request a hearing on the Administrative Penalty. (Reference #RHP 06-04)
Mirant Consent Decree, Prince George’s County – On September 11, the Consent Decree recently signed by MDE and Mirant was signed by the Prince George’s County Circuit Court. The Decree is now final and will be entered into the Court docket shortly. The Decree requires Mirant’s Chalk Point Electrical Generating Units 3 and 4 to reduce air emissions of nitrogen oxide, sulfur oxides, and particulate matter. The reductions will be achieved by converting to natural gas as fuel during the summer ozone season and by implementing a number of other improvements to the operation of the plant. The Decree also tightens emission standards for opacity, particulate matter, and sulfur oxides, as well as requiring testing of the units for compliance with air emissions standards. A $75,000 penalty is also included in the Decree. Status: Case Closed. (Reference #AQCP 060911)
Peninsula Regional Medical Center – Wicomico County – On September 8, MDE issued a Complaint, Order, and Administrative Penalty in the amount of $6,000 to Peninsula Regional Medical Center for a radiation misadministration. Peninsula allowed a patient to be treated with radiation therapy in the wrong treatment area for a three-day period. Alliance/Burkehart Fuel Co., Baltimore City – On August 22, MDE issued a Complaint, Order and Administrative Penalty equaling $15,000 to Alliance/Burkehart Fuel Co. for violating Maryland’s laws governing oil pollution by causing an oil spill while delivering home heating oil, and failing to contain, control and clean up the spill. As a result, oil entered the home, the soil, a nearby storm drain, and caused petroleum odors downstream from the site. MDE hired an environmental contractor to abate the emergency and cleanup the spill. Ralph Fisher, et al, Baltimore City – 100 affected properties – On September 5, MDE entered into a Settlement Agreement and Consent Order with Ralph Fisher, et al. The agreement contained a civil penalty of $5,225 for violating Maryland’s Lead Laws by failing to bring the affected properties into compliance with risk reduction standards. Status: Ralph Fisher, et al have agreed to pay the penalty, bring their non compliant properties into compliance with lead reduction requirements, and replace all window wells and sills containing lead based paint at 32 properties. New Oak Equity Limited Partnership, Baltimore County – 347 affected properties – On August 22, MDE entered into a Settlement Agreement and Consent Order with New Oak Equity Limited Partnership that requires New Oak Equity Limited Partnership to pay fees totaling $30,960 to MDE, and meet other requirements of Maryland laws and regulations governing the reduction of lead paint hazards in pre-1950 residential rental dwelling property units. Status: New Oak Equity Limited Partnership has paid the required fees. (Case Number 2006-03-9227)
P. G. Tire, Inc., Prince George’s County – On August 22, MDE issued a Complaint, Order and Penalty equaling $6,000 to P. G. Tire, Inc. for violating Maryland’s Laws and Regulations regarding the disposal of scrap tires by failing to submit semi-annual reports to the Department. Status: P. G. Tire, Inc. has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number C-O-AP-06-ST-133)
Water Management Administration
Harford County Public Schools, Harford County - On August 3, 2006, MDE finalized an administrative consent order with Harford County Public Schools regarding improvements at the North Harford High School Wastewater Treatment Plant located at 211 Pylesville Road in Pylesville. Under the terms of the consent order, Harford County has completed an upgrade to the wastewater treatment plant and is required to pay $4,000 to the Maryland Clean Water Fund to resolve alleged effluent fecal coliform and total suspended solids effluent violations of State Discharge Permit 00-DP-0884 during the period January 1, 2004 through November 30, 2005. Status: Case closed. (Reference #CO-07-0347).
Town of Centreville, Queen Anne’s County – On September 11, 2006, MDE and the Town of Centreville finalized an administrative settlement agreement resolving two sanitary sewer overflows from Centreville’s sanitary sewer collection system that occurred on April 27 and 28, 2005. Under the terms of the settlement agreement, Centreville is required to pay $250 to the Maryland Clean Water Fund and to expend $32,000 to complete a supplemental environmental project by February 1, 2008 that requires planting of a vegetative buffer around Centreville’s wastewater spray field. Status: Case closed. (Reference # SA-07-0371).
Water and Sediment Pollution Penalties – Statewide During the period August 15, 2006 to September 15, 2006, MDE collected an additional $11,750 to the Clean Water Fund in resolution of alleged water pollution violations from five facilities.
