Air & Radiation Management Administration
Citrus & Allied Essences, Ltd., Harford County -- On March 15, MDE received payment of $2,100 from Citrus & Allied to address violations of air quality regulations. MDE and the Company signed a Consent Order earlier this month that required the Company to pay the penalty within 30 days. During an inspection, MDE determined that the Company violated an air quality permit condition regarding operation of its reactors. The violations have since been addressed. Citrus & Allied is a manufacturer of flavorings and fragrances for food and other products, located in Belcamp, Harford County. Status: Case Closed. (Reference # AQCP 060309)
Fil-tec, Washington County -- On March 22, MDE signed a Consent Order with Fil-tec to provide for installation of a new air pollution control device. The Consent Order requires the Company to purchase and retire emissions offsets to compensate for excess emissions generated during the construction period. Fil-tec receives, stores, and applies methanol to threads using coating machines. Due to an increase in business and an upcoming compliance date with federal air toxics requirements, the Company is adding another emission control device. Status: Case Closed. Allegheny Energy Supply, R. Paul Smith, Washington County -- On March 31, MDE issued a Notice of Assessed Civil Penalty in the amount of $20,000 to Allegheny Energy Supply for violations of their NOx emission standard. Allegheny Energy operates an electrical power generator station called R. Paul Smith. The facility is a major source of NOx emissions and is required to have a Part 70 operating permit. Status: Allegheny Energy has 30 days to request a hearing. (Reference #ACP 05-28A)
Carroll County Cancer Center - Carroll County -- On April 6, MDE issued a Complaint, Order, and Administrative Penalty in the amount of $2,000 to Carroll County Cancer Center for a radiation misadministration that occurred at the treatment facility. The facility allowed a patient to be treated with the treatment plan prescribed for another patient. Status: Carroll County Cancer Center has 10 days to request a hearing on the Order and 30 days to request a hearing on the Administrative Penalty. (Reference #RHP 06-00)
Chesapeake Cancer Center, Harford County -- On April 6, MDE issued a Complaint, Order, and Administrative Penalty in the amount of $2,000 to Chesapeake Cancer Center for a radiation misadministration that occurred at the treatment facility. The facility allowed a patient to be treated with the treatment plan prescribed for another patient. Status: Chesapeake Cancer Center has 10 days to request a hearing on the Order and 30 days to request a hearing on the Administrative Penalty. (Reference #RHP 06-01)
Washington County Hospital, Washington County -- On April 7, MDE received a penalty payment in the amount of $40,000 from Washington County Hospital. The payment settles an enforcement action that resulted from violations for failing two stack tests for dioxins/furans. Washington County Hospital operates a medical waste incinerator subject to Federal and Maryland emissions and operating limits. The incinerator twice failed a stack test for dioxins/furans. The Hospital made improvements to the incinerator and has since passed two recent stack tests. Status: Case Closed. (Reference #ACP 04-05A)

Professional Graphics Printing Co., Prince George’s County – On April 12, MDE issued a Complaint, Order and Administrative Penalty equaling $5,000 to Professional Graphics Printing Co. for violations of Maryland’s law and regulations regarding Controlled Hazardous Substances. An inspection of the Professional Graphics Printing Co. facility in Laurel, Maryland found that the facility accumulated flammable liquid hazardous waste without having received a permanent EPA identification number, and failed to have adequate, properly labeled containers for this liquid hazardous waste. Status:Professional Graphics Printing Co. has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number C-O-06-043)
The Grier Tire Co., Wicomico County – On March 15, MDE issued an Administrative Complaint, Order and Penalty equaling $15,000 to The Grier Tire Co. for violations of Maryland’s regulations concerning scrap tire collection facilities. The order requires the Grier Tire Co. to cease the handling of any scrap tires and remove all scrap tires from their facility in Salisbury. Status: The Grier Tire Co. has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number C-O-AP-06-ST-028)

JHB Properties, LLC., Baltimore City – 11 affected properties – On April 7, MDE signed a Settlement Agreement and Consent Order with JHB Properties, LLC. concerning violation of Maryland’s Lead Laws. The agreement contained a penalty equaling $5,250, and requires JHB Properties, LLC. to register their properties, and bring the affected properties into compliance with risk reduction standards. Michel Property Management, LLC, Frederick County – 13 affected properties – On April 12, MDE signed a Settlement Agreement and Consent Order with Michel Property Management, LLC. concerning violation of Maryland’s Lead Laws. The agreement contained a penalty equaling $5,750, and requires Michel Property Management, LLC. to register their properties, and bring the affected properties into compliance with risk reduction standards. Status: In accordance with the approved payment plan the first payment of $1,000 has been made. (Case Number 2006-10-8793)
Water Management Administration
Safeway Inc., Queen Anne’s County – On March 17, MDE issued an Administrative Complaint and Penalty against Safeway Inc. for alleged sediment control and water pollution violations pertaining to construction activities at Safeway’s construction site located at 1912 Main Street, Chester, Queen Anne’s County, Maryland. MDE is seeking a penalty of $43,600 for Safeway’s failure to comply with the General NPDES Stormwater Permit for Construction Activity issued for the site as well as the site’s approved sediment control plan and for sediment pollution to Macum Creek. Status: Case pending opportunity for appeal. (Reference #AP-06-0280).
JCR, Enterprises, Inc., Dorchester County – On April 4, MDE filed a Complaint for Civil Penalties against JCR Enterprises, Inc. in the Circuit Court for Dorchester County alleging water pollution violations at JCR’s poultry rendering plant wastewater treatment facility located at 5420 Linkwood Road, Linkwood, Maryland. MDE is seeking civil penalties of up to $10,000 per day for alleged violations of the facility’s NPDES permit and for unlawful discharges to an unnamed tributary to Higgins Millpond, waters of the State, that occurred during the period August 3 through 29, 2005. Status: Case pending opportunity for appeal. (Reference Case #C-06-14139).
Buffalo Coal Company, Inc., Allegany County – On April 12, MDE issued an Administrative Complaint, Order and Civil Penalty against Buffalo Coal Company, Inc. for alleged water pollution violations at its Phillips surface coal mine site located in Lonaconing, Maryland. The Complaint alleges violations of the site’s NPDES permit effluent limits for pH, manganese and total suspended solids and for failing to properly operate a treatment system to prevent untreated acid mine discharges to Jackson Run, waters of the State. MDE has ordered Buffalo Coal to comply with the discharge permit within 24 hours. MDE is seeking an administrative penalty of $50,000. Status: Case pending opportunity for appeal. Lawrence Johnston Farm, Somerset County – On April 6, 2006, MDE issued an Administrative Complaint and Penalty against Lawrence Johnston for alleged water pollution resulting from the placement of poultry manure in a position likely to pollute waters of the State at his poultry farm located in Princess Anne, Maryland. MDE is seeking an administrative penalty of $1,000 in this case. Status: Case pending opportunity for appeal. (Reference #AP-06-0287).
Water and Sediment Pollution Penalties – Statewide
During the period March 15, 2006 to April 15, 2006, MDE collected an additional $2,250 to the Clean Water Fund in resolution of alleged water pollution violations from three facilities and $49,300 to the Sediment Fund in resolution of alleged sediment control violations at eight sites.
