Full Moon BBQ Restaurant, Baltimore City -- On Oct. 14, MDE issued a Corrective Order to the Full Moon BBQ Restaurant in response to visible emissions and air pollution nuisance violations. Twelve violation notices have been issued by MDE. As background, citizens near the restaurant have complained to the City Health Department and MDE about smoke and odors from the restaurant. MDE has issued Notices of Violation to the restaurant for exceeding the visible emission limit and creating an air quality nuisance to the nearby community. The order requires that Full Moon complete installation of an emission control system to eliminate the visible emissions and eliminate air pollution nuisance violations. Status: Full Moon has 10 days to appeal. (Reference #AQCP 05-10-02)
VAC PAC, Inc., Baltimore City -- On Nov. 1, MDE issued a Notice of Assessed Civil Penalty to VAC PAC, Inc. for $8,000 for violations of air quality requirements. VAC PAC is a printer located in Baltimore City that prints labels on plastic bags used for bread. During an inspection, MDE determined that the company violated a permit condition requiring the company to test its control device twice annually. The company failed to conduct the tests in the last calendar year. Periodic testing provides assurance that the VOC control device is working properly. Status: VAC PAC has 30 days to request a hearing. (Reference #ACP 05-05A)
G & K Services, Prince George’s County -- On Nov. 2, MDE issued an “Opportunity to Settle Letter” to G & K Services for air pollution violations. G & K Services operates an industrial laundry facility located in Laurel, Prince George’s County. G & K hired a consultant to conduct an environmental assessment of the facility. During the assessment, it was discovered that the facility is a major source of volatile organic chemicals. It was further determined that G&K lacked air quality permits and had not implemented required air pollution controls. The letter provides an opportunity for G&K to discuss the violations and potential settlement with MDE prior to the Department filing formal charges in court. Status: G & K Services has 20 days to respond to MDE. (Reference #AQCP 051102)
Baltimore Spice, Baltimore County-- On Nov. 9, MDE issued a Notice of Assessed Civil Penalty in the amount of $45,000 to Baltimore Spice for violations of air quality requirements. During an inspection, MDE discovered that the facility violated various air quality requirements that include failure to operate air pollution equipment within specified parameters, and failure to comply with federal air toxics reporting requirements. MDE issued a Notice of Violation and corrective actions have been implemented by the Company to resolve the noncompliance issues. Baltimore Spice operates a spice manufacturing facility in Owings Mills, Baltimore County. Status: Baltimore Spice has 30 days to request a hearing. (Reference # ACP 05-01A)
Water Management Administration
International Minerals and Raw Materials, Inc., Carroll County – On Oct. 21, MDE and International Minerals and Raw Materials, Inc. (IMRM) finalized an administrative consent order requiring IMRM to implement corrective measures to clean up and close out its foundry sand processing facility located at 1221 Bruceville Road, Keymar, Carroll County, Maryland 21757. Under the terms of the consent order, IMRM must complete site close out by March 31, 2006 and pay a penalty to the Maryland Clean Water Fund in the amount of $15,000 to resolve past water pollution violations. Status: Case closed. (Reference #CO-06-0211).
Sun U. Ferguson, Charles County – On Oct. 17, MDE issued an administrative Complaint, Order and Penalty against Sun U. Ferguson, owner of residential property located at 10871 Trinity Church Road, Charlotte Hall, Maryland, regarding water pollution resulting from the owner’s failed septic system. The order requires the owner to pump and haul wastewater from the septic system by a licensed septic system hauler to prevent unlawful discharges. The owner is also required to repair the septic system under the approval of the Charles County Health Department. MDE is seeking an administrative penalty of $3,000 in this case. Status: Case pending appeal. (Reference # AO-06-0205).
Water and Sediment Pollution Penalties – Statewide
During the period Oct. 15 to Nov. 15, 2005, MDE collected an additional $6,423 to the Clean Water Fund in resolution of alleged water pollution violations from three facilities.
