Baltimore Spice, Baltimore County -- On December 10, 2005 MDE received a penalty payment of $45,000 from Baltimore Spice for violations of air quality requirements. During an inspection, MDE discovered that the facility violated various air quality requirements, including failure to operate air pollution equipment within specified parameters, and failure to comply with federal air toxics reporting requirements. Corrective actions have been implemented by the Company to resolve the noncompliance issues. MDE had a similar case with Baltimore Spice in early 2000. Baltimore Spice operates a spice processing facility in Owings Mills, Baltimore County. Status: Case Closed. (Reference #AQCP 05-01A)
Sasol North America , Baltimore City --On December 30, 2005 Sasol made a penalty payment of $30,000 as agreed to in a recently signed Consent Order between MDE and Sasol. The Order settled an enforcement case arising from the illegal release of chemicals into the atmosphere. Sasol has since corrected the cause of the incident. The case resulted from the release of several thousand pounds of Volatile Organic Compounds (VOC), resulting in violations of air quality regulations. Sasol, located in Fairfield, manufactures an intermediate material that is used to make soaps and detergents. Status: Case Closed. (Reference #AQCP 051201)

Chesapeake Airways Services Corporation, White’s Aircraft Parts t/a Chesapeake Airways and Salisbury Ocean City: Wicomico Regional Airport,Wicomico County – Chesapeake Airways Services Corporation, White’s Aircraft Parts t/a Chesapeake Airways and Salisbury Ocean City: Wicomico Regional Airport were issued a Complaint, Order and Administrative Penalty December 21, 2005 for violations of Maryland laws and regulations regarding Controlled Hazardous Substances. The Complaint and Order notice contained a Penalty of $50,000. Status: Chesapeake Airways Services Corporation, White’s Aircraft Parts t/a Chesapeake Airways and Salisbury Ocean City: Wicomico Regional Airport have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. Verlin Lovett – 2 affected properties, Wicomico County – Verlin Lovett was issued an Administrative Complaint and Penalty equaling $35,000 on December 19, 2005 for violating Maryland’s Lead Laws by failing to bring each affected property into compliance with risk reduction standards. Management Corp. and Mr. Kent Sanders were issued an Administrative Complaint and Penalty equaling $60,000 on December 19, 2005 for violating Maryland’s Lead Laws by failing register their properties, and failure to bring their affected properties into compliance with risk reduction standards. Kenneth W. Apple – 10 affected properties, Washington County – Kenneth W. Apple was issued an Administrative Complaint and Penalty equaling $35,000 on December 19, 2005 for violating Maryland’s Lead Laws by failure to bring each affected property into compliance with risk reduction standards. Water Management Administration
Spurry Family Partnership, Talbot County --On January 27, MDE and Spurry Family Partnership finalized an administrative consent order requiring installation of a holding tank and abandonment of the existing failed septic system at the Chesapeake Landing Seafood Restaurant located in McDaniel, Maryland. Under the terms of the consent order, Spurry Family Partnership must pump and haul wastewater from the restaurant for off site disposal and submit to the Talbot County Health Department, within 30 days, a completed application for a Sanitary Construction Permit to install a holding tank. The holding tank must be installed and the old system abandoned within 60 days following approval by the Talbot County Health Department. Status: Case closed. (Reference# CO-05-0079).
Water and Sediment Pollution Penalties – Statewide
During the period December 15, 2005 to January 15, 2006, MDE collected an additional $500 to the Sediment Fund in resolution of alleged erosion and sediment control/sediment pollution violations from one site and $12,300 to the Clean Water Fund in resolution of alleged water pollution violations at two facilities.
