In accordance with Sections 1-601, 1-602, 1-604, and 9-209 of the Environment Article, Annotated Code of Maryland, we made a Tentative Determination to approve a Refuse Disposal Permit Application submitted by Tolson & Associates,LLC for the proposed vertical expansion of the Tolson & Associate Rubble Landfill located at the end of Capitol Raceway Road, Crofton in Anne Arundel County. 

The proposed vertical expansion will occur within the footprint of the existing landfill and will increase the maximum permitted elevation of the landfill within the limits of the County’s local zoning approval, to provide a more efficient use of the airspace that allows an increased overall capacity from 230 feet above mean sea level (amsl) to 244 feet amsl. Tolson & Associates Rubble Landfill is a non-hazardous solid waste acceptance facility that accepts land clearing debris and construction and demolition debris for disposal and recycling. Vertical expansion was approved to increase landfill height. The 2019 proposal was within the footprint of the existing landfill and would increase the maximum permitted elevation of the landfill within the limits of the County’s local zoning approval, to provide more efficient use of the airspace that allows an increased overall capacity from 230 feet above mean sea level (AMSL) to 244 feet AMSL. 

The Tolson Rubble Landfill is located on a 199.5-acre site at the end of Capital Raceway Road in Crofton, Maryland (39.045 N, 76.706 W). Activities include construction and demolition debris disposal, surface mining, natural wood waste recycling, and composting. The permittee is Tolson & Associates, LLC, 24012 Frederick Road, Suite 200, Clarksburg, MD 20871.

Solid Waste Permits

The solid waste program issued a Refuse Disposal Permit 2003-WRF-0580 in 2014 for a construction and demolition debris landfill in Crofton, Anne Arundel County.  The permit requires the facility to meet all applicable environmental laws and regulations for disposal of construction and demolition debris. The permit became effective on November 24, 2014. The permittee is Tolson & Associates, LLC, 24012 Frederick Road, Suite 200, Clarksburg MD  20871.

Air Quality Permits

Tolson and Associates Rubble Landfill applied to install a waste concrete crushing and screening plant to their existing landfill operations. The plant was intended to crush waste concrete for Tolson's concrete recycling operation and had a maximum operating capacity of 200 tons per hour. The equipment included one primary jaw crusher (Metso LT106), one secondary cone crusher (Metso LT1213), one Metso 2-deck 5’x16’ scalping screen, one Metso 2-deck 18’x5’ screen, 17 conveyors, two Tier III 100-horsepower diesel engines, one Tier IVi 252-horsepower diesel mobile generator, one Tier IIIB/Tier IVi 415-horsepower diesel engine, one Tier II 300-horsepower diesel engine, three feeders, one hopper, and wet suppression systems for fugitive dust control.

Mining Permit

MDE's Mining Program has issued Surface Mining Permit No. 78-SP-0087-J to Tolson & Associates, LLC for the surface mine known as Cunningham Pit. The permit area shall not exceed 181.468 acres. To minimize the effects of mining on the environment, provide proper land reclamation, and ensure public safety, a permit is required to conduct surface mining.​

Wastewater Permit

MDE's Wastewater Permits Program issued registration No. 15MM-9709 on November 27, 2017, for coverage of the facility under General Discharge Permit 15MM. General Discharge Permit 15MM covers discharges from mineral mines, quarries, borrow pits, and concrete and asphalt plants.

Meetings

Pursuant to the Environment Article, Sections 1-601 and 1-603, Annotated Code of Maryland, a Virtual Informational Meeting and Public Hearing were scheduled for interested citizens to obtain information about the permit renewal and MDE’s Tentative Determination. To provide an opportunity for interested citizens to learn about the proposed vertical expansion of the existing landfill and MDE’s Tentative Determination, a virtual Informational Meeting and Public Hearing were held in accordance with Executive Order of the Governor of the State of Maryland No. 21-03-09-03, on Tuesday, June 29, 2021, at 6:30 p.m.

Participants registered through the provided link, and once registered, directions to participate online or by phone were electronically forwarded to the email address provided. Participants using a computer or mobile device to join the online public meeting had the opportunity to submit comments online. Phone-only participants did not have the ability to ask questions or comment during the meeting; however, questions and comments could be sent to Mr. Samuel Ogbogu via e-mail at [email protected] or by phone at 410-537-3315. Questions and comments were required to be received by June 25, 2021, in order to be read at the Virtual Informational Meeting and Public Hearing.

The permit application, supporting documents, and draft permit were made available for review after May 28, 2021, on the Tolson Rubble Landfill page. Hard copies were also available for public review at the Crofton Community Library Branch of the Anne Arundel County Library System located at 1681 Riedel Road, Crofton, Maryland 21114.

Written comments regarding the application could be submitted to Ms. Kaley Laleker, Director, Land and Materials Administration, Maryland Department of the Environment, 1800 Washington Boulevard, Suite 610, Baltimore, Maryland 21230 within 30 days of the publication of the Tentative Determination.
