 ​NOTICE - Draft Permit Renewal Announcement ​​​

The Department has proposed a Tentative Determination and published notice of a Public Hearing for the 22-MM General Permit for Discharges ​from Mineral Mines, Quarries, Borrow Pits, and Concrete and Asphalt Plants.  Information regarding the tentative determination is presented below:

The public notice (above) contains a list of changes from the previous permit.  Any questions regarding the proposed permit should be directed to Paul Hlavinka at paul.hla​vinka@maryland.gov or by telephone at 410-537-3323.  Email correspondence is recommended for ​a more expedient response.

Any written comments regarding the tentative determination should be addressed to Paul Hlavinka.  Full details on how to submit comments via email, mail, or fax are included in the public notice.​

Important Dates

  • December 22, 2022 - A public hearing is scheduled from 1 p.m. to 3 p.m. in the Aqua Conference room at Maryland Department of the Environment Headquarters, 1800 Washington Blvd., Baltimore, MD 21230.  An opportunity to submit oral comments for the record will be provided for all attendees.
  • December 30, 2022 - The deadline for submission of written comments​ regarding the tentative determination concludes at 5 p.m. on this date.

​Existing Permit - General Discharge Permit No. 15-MM (NPDES No. MDG49)

​The 15-MM general permit became effective on May 1, 2017. 

Change in Required Documentation

In recognition that the permit is beyond its five-year term, and in recognition that NPDES permits have a maximum duration of five years, the Department is discontinuing the acceptance of new registrations under permit 15-MM.  Proposed new discharges from mineral mines, quarries, borrow pits, and concrete and asphalt plants submitted will not be allowed to obtain general permit coverage until a new permit is issued.

In place of permit coverage under the expired permit, the Department has issued an Order to cover proposed new discharges from mineral mines, quarries, borrow pits, and concrete and asphalt plants if an applicant meets the 15-MM eligibility criteria and declares intention to operate in accordance ​with the terms of the Consent Order and 15-MM.  The applicant should submit a Declaration of Intent and complete the registration/certification process in accordance with the requirements otherwise set forth for registrations under permit 15-MM.

Note that existing registrations under the General Permit 15-MM continue to be covered under the existing administratively extended permit (per the terms of the permit).  Please check back here for updates as progress is made towards that end or sign up for our newsletter.  Once a draft of the new permit has been proposed to open the public participation process, the Department will take comments prior to arriving at a final permit.​
