:: Enforcement and Compliance Notes for Mid-June to Mid-July 2005

Air & Radiation Management Administration

Franklin Square Hospital Center – Baltimore County--On June 21, MDE received a $20,000 penalty payment from Franklin Square Hospital. The penalty payment was required by a recently signed Consent Order between MDE and Franklin Square for air quality violations. The hospital operates a medical waste incinerator subject to federal medical waste incinerator regulations. MDE is delegated to enforce these regulations in Maryland. Based on inspections and data review, MDE determined that Franklin Square violated these regulations with numerous operating parameter exceedances and by operating with the bypass stack open. Status: Case Closed. (Reference # AQCP 050614)

Perry Hall High School – Baltimore County Public Schools --On June 30, MDE issued a Notice of Proposed Civil Penalty in the amount of $3,000 to Baltimore County Public Schools (BCPS) in response to asbestos violations at Perry Hall High School. Specifically, BCPS hired an unlicensed contractor to perform asbestos work in the boiler room of Perry Hall High School. Asbestos workplace practices and worker safety standards were also violated. MDE previously issued a penalty to the contractor. Status: BCPS has 10 days to request a meeting. (Reference #ACP 05-22P)

Southwestern Academy – Baltimore County Public Schools--On June 30, MDE issued a Corrective Order and Notice of Proposed Civil Penalty in the amount of $4, 500 to Baltimore County Public Schools (BCPS) in response to asbestos violations during renovation and demolition work at Southwestern Academy. MDE also issued penalties on this date to the general contractor and the subcontractor for violating asbestos requirements. The violations occurred when old boiler units were demolished and removed from Southwestern Academy. Status: The entities have 10 days to request a meeting. (Reference #AQCP 05-06-05 and ACP #s 05-19P, 05-20P, and 05-21P)

John Marsh Cancer Center – Washington County--On July 7, MDE issued a Complaint, Order, and Administrative Penalty in the amount of $2,000 to John Marsh Cancer Center (JMCC) for failure to comply with regulations governing the owning or operating of radiation machines. The Complaint was issued because JMCC had allowed a patient to be treated with a treatment plan prescribed for another patient. Status: JMCC has 10 days to appeal the order. (Reference # RHP 05-01)

EnviroControl Inc – St. Mary’s County-- On July 11, MDE signed a Consent Order with EnviroControl to resolve an asbestos enforcement action. The Order required EnviroControl to make a settlement payment of $6,500. Status: Case Closed. (Reference # AQCP 050711)

Gas Station Stage II Vapor Recovery Cases--On June 29, MDE issued Corrective Orders and Notices of Proposed Civil Penalty to eleven gas stations. The actions addressed various violations of the Stage II Vapor Recovery regulations. The proposed penalties range from $1,100 to $4,000. The violations were discovered by MDE inspectors during inspections of the gas stations. Status: The stations have 10 days to request a meeting and appeal.

Water Management Administration

Crisfield Wastewater Treatment Plant – Somerset County-- On April 26, MDE finalized an administrative consent order with the City of Crisfield regarding improvements to the Crisfield Wastewater Treatment Plant located at 104 Seventh Street, Crisfield, Maryland. Under the terms of the consent order, Crisfield is required to complete construction and start up of an enhanced biological nutrient removal (ENR) upgrade to the wastewater treatment system by May 1, 2007. The consent order has established interim performance standards for biochemical oxygen demand and total suspended solids in the effluent discharged from the plant during construction and stipulated penalties for violations of those standards as well as any violations of applicable discharge permit effluent limitations. Status: Case closed. (Reference # CO-05-0120).

Charles Upton Mehring and International Minerals and Raw Materials, Inc. (IMRM) – Carroll County--On June 27, MDE issued Notice of Violation and Corrective Work Order to Defendants Charles Mehring and IMRM for waterway obstruction violations under Title 5 of the Environment Article at the property located at Keymar Recycling Center at 1221 Bruceville Road in Keymar, Maryland. The Corrective Work Order requires Defendants to Submit to MDE for review within 30 days the results of an engineering evaluation of a clogged culvert on the property and within 60 days to submit to MDE for review and approval a corrective action plan and time schedule for the repair or replacement of the culvert and to obtain a Waterway Construction Permit from MDE upon approval of the plan in order to complete the work. Status: Case pending appeal. (Reference # AO-05-0151).

William Costello – Anne Arundel County-- On April 26,William Costello pled guilty in the Circuit Court of Anne Arundel County to one count of filling wetlands without a license and one count of failing to obtain a sediment control plan at his property located on 1423 Sharps Point Road in Annapolis, Maryland. Judge Joseph Manck convicted Mr. Costello on both counts. Upon conviction, Judge Manck sentenced Mr. Costello to 30 days in jail, with all 30 days suspended; one-year of supervised probation; and imposed a $10,000 fine. Nine thousand dollars of the fine was ordered paid to the Maryland Sediment Control Fund. This case was referred to the Office of the Attorney General’s Environmental Crimes Unit for prosecution. Status: Case closed. (Reference # AA Circuit Court 02K042407).

Wade B. Stine,Jr. – Charles County-- On June 13, MDE issued an administrative complaint and order to Wade Stine requiring that he connect his property at 15645 Woodland Point Road in Newburg, Maryland to the Charles County Cobb Island Wastewater Treatment Plant due to a substandard septic system. Mr. Stine has 60 days to complete the connection and thereafter properly disconnect and abandon the substandard septic system. Status: Case pending. (Reference # AO-05-0144).

June E. Thomas – Charles County-- On June 13, 2005, MDE issued an administrative complaint and consent order to June Thomas requiring that Ms. Thomas connect her property at 12230 Potomac View Road in Newburg, Maryland to the Cobb Island Wastewater Treatment Plant due to a substandard septic system. Ms. Thomas has 60 days to complete the connection and thereafter properly disconnect and abandon the substandard septic system. Status: Case pending. (Reference # AO-05-0145).

Water and Sediment Pollution Penalties – Statewide-- During the period June 15, 2005 to July 15, 2005, MDE collected an additional $26,350 to the Sediment Fund in resolution of alleged erosion and sediment control/sediment pollution violations from seven sites and $5,400 to the Clean Water Fund in resolution of alleged water pollution violations at four facilities.

Curtis and Sonia Eaddy – Baltimore City-- Two affected properties - Curtis and Sonia Eaddy were issued an amended Administrative Complaint, Order and Penalty equaling $13,000 on July 8 for violating Maryland’s Lead Laws by failing to register pre-1950 rental properties and failing to bring each affected property into compliance with risk reduction standards. Status: Curtis and Sonia Eaddy have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 02-30-5693)

Frank Eubank – Baltimore City-- One affected property - Frank Eubank was issued an amended Administrative Complaint, Order and Penalty equaling $18,000 on July 8, 2005 for violating Maryland’s Lead Laws by failing to register a pre-1950 rental property and failing to bring the affected property into compliance with risk reduction standards. Status: Frank Eubank has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 04-30-7507)

Tyrone Lee – Baltimore City-- Eight affected properties - Tyrone Lee was issued an Administrative Complaint, Order and Penalty equaling $30,000 on July 12 for violating Maryland’s Lead Laws by failing to register pre-1950 rental properties and failing to bring each affected property into compliance with risk reduction standards. Status: Tyrone Lee has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 04-30-7699)

William S. Broaddus – Baltimore City-- One affected property - William S. Broaddus was issued an Administrative Complaint, Order and Penalty equaling $8,000 on July 12 for violating Maryland’s Lead Laws by failing to register a pre-1950 rental property and failing to bring the affected property into compliance with risk reduction standards. Status: William S. Broaddus has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 04-30-7594)

Bernie and Gloria Richardson – Baltimore City--One affected property - Bernie and Gloria Richardson were issued an Administrative Complaint, Order and Penalty equaling $10,000 on July 12, for violating Maryland’s Lead Laws by failing to register a pre-1950 rental properties and failing to bring the affected property into compliance with risk reduction standards. Status: Bernie and Gloria Richardson have 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 04-30-7761)

Queen Anne Corporation – Baltimore City--Twenty-four affected properties - Queen Anne Corporation was issued an amended Administrative Complaint, Order and Penalty equaling $61,000 on July 12, 2005 for violating Maryland’s Lead Laws by failing to register pre-1950 rental properties and failing to bring each affected property into compliance with risk reduction standards. Status: Queen Anne Corporation has 10 days to request a hearing on the Complaint and Order and 30 days to request a hearing on the Penalty. (Case Number 04-30-7173)
