Regulation TitleConditional Exclusion for Solvent Contaminated Wipes
PurposeAdopt federal regulations that revise the definition of solid waste to conditionally exclude solvent contaminated wipes that are cleaned and reused, and revise the definition of hazardous waste to exclude certain solvent contaminated wipes (not including wipes contaminated with trichloroethylene) if they are managed in specified ways.

Regulation TitleUniversal Waste Rule for Aerosol Cans
PurposeAdopt federal regulations that expand the category of “universal waste” in the hazardous waste regulations to include aerosol cans.  The universal waste regulations are an alternate set of simplified management standards that apply to specific categories of wastes, and are intended to facilitate collection, recycling, and proper management of eligible wastes.

Regulation TitleManagement Standards for Hazardous Waste Pharmaceuticals
PurposeAdopt federal regulations on management of hazardous waste pharmaceuticals at healthcare facilities.  The federal regulations appear in the Code of Federal Regulations at 40 CFR Part 266 Subpart P.

Regulation TitleMixed Waste Rulemaking

Regulation Title
Hazardous Waste Identification Rule – Contaminated Media and Debris
Purpose
Establishes a Department approved remedial action plan as a form of permit when operations involved in cleaning up a contaminated site would otherwise trigger permit requirements for hazardous waste treatment or disposal.

ProgramResource Management Program
Regulation TitleStorage, Collection, Transferring, Hauling, Recycling, and Processing of Scrap Tires
PurposeTo update and modernize the existing regulations on scrap tire management in the state. Revisions to these regulations will include changes to the terms for scrap tire licenses and approvals, updates to the scrap tire licenses and approvals application requirements, creation of a scrap tire hauler exemption, reduced reporting requirements, and other clarifying and formatting changes.

ProgramSolid Waste Program
Regulation TitleRecycling Facilities (New Chapter)
PurposeAs required under Ch. 376 of 2017, to develop regulations for recycling facilities that clarify when a refuse disposal permit is or is not required, exempt certain materials managed at a recycling facility from being designated as solid waste, and to establish other requirements and approvals for recycling facilities. These regulations will be adopted under a new chapter.

StatusThe meetings of the Solid Waste and Recycling Facilities Workgroup have concluded, which consisted of affected stakeholders consulted in the development of the regulations. The proposal is being drafted.

ProgramSolid Waste Program
Regulation TitleManagement of Coal Combustion Byproducts
PurposeTo make the changes needed to the existing regulations governing coal combustion byproducts (or coal ash), due to the promulgation of federal regulations governing coal combustion residuals disposal that became effective in October 2015.

Relevant Statutory DeadlineFederal regulations encourage incorporation within 18 months of October 19, 2015. However, the U.S. EPA is proposing and adopting revisions to the 2015 federal coal combustion residuals disposal regulations.
