BALTIMORE, MD (May 22, 2007) – The Maryland Department of the Environment (MDE) Water Management Administration Compliance Program issued the following enforcement actions between April16 and May 10, 2007:
Mid-Shore Regional Landfill, Caroline County
On April 16, MDE issued two Site Complaints, one for nontidal wetlands filling and one for a sediment control violation. The Site Complaints were issued to the Caroline County Commissioners for activities at the Holly Road Solid Waste Landfill and Collection Station, a section of the Mid-Shore Regional Landfill in Ridgely, Caroline County. While the violations are of a relatively small area, the disturbance is greater that 5,000 square feet and the stockpiling of fill has resulted in the filling of delineated nontidal wetlands. The orders direct the County to immediately remove all fill from the nontidal wetland, to stabilize the disturbed wetland with annual ryegrass, to obtain erosion and sediment control approval if any additional stockpiling is to be performed, and to vegetatively stabilize the stockpile. All corrections are to be implemented immediately.
Stavlas Brothers, Inc., Anne Arundel County
On April 19, MDE issued a Site Complaint and Order to Stavlas Brothers, Inc. for grading and clearing in a regulated non-tidal wetlands and floodplain without approvals from MDE. The Order directs Stavlas Brothers to cease all activity at the Princess Shopping Center Project in Anne Arundel County, and to stabilize the disturbed areas. Stavlas is required to obtain a Notice of Intent to be covered by the General Permit for Stormwater Associated with Construction Activities and nontidal wetlands approval from MDE before continuing work on this project. Stavlas Brothers have refused to sign the Site Complaint and Order and have it forwarded to their attorney.
Hopkins and Wayson, Calvert County
On, April 20, MDE issued a Site Complaint and Order to Hopkins and Wayson for failure to implement and maintain the approved erosion and sediment control plan and placing sediment in a position likely to pollute. The site is also in violation of the issued Notice of Intent to be covered by the General Permit for Stormwater Associated with Construction Activities for the site. The Order directs Hopkins and Wayson to cease all activity at Sunderland Business Park in Calvert Co., except that which is necessary to bring the site into compliance with the approved erosion and sediment control plan. The site may resume work once the MDE is satisfied that compliance with the approved plan has been achieved.
Crouse Brothers Construction, Cecil County and Louis Ramunno, Wilmington, Delaware
On May 3, MDE issued a Site Complaint with an Order to Crouse Brothers Construction of Cecil County and Louis Ramunno of Wilmington, Delaware, for failure to install and maintain sediment controls as per the approved plans. The violation site is located within the town of Elkton Cecil County and is referred to as Northside Center. The owners and contractors were advised that no work other than work to install sediment controls may occur at the site until the site is brought back into compliance with the approved plans.
Lacrosse Homes, Inc., Queen Anne’s County
On May 10, MDE issued a Site Complaint with an Order to Lacrosse Homes, Inc., for failure to install sediment controls as per the approved plans. Lacrosse Homes was advised that no work other then sediment control items may be performed at the site until the site is brought back into compliance. The site in question is located in Queen Anne’s County at Cecil Drive in Chester, which backs up to Cox Creek.
Bay County Enterprises, Inc., St. Mary’s County
On May 10, MDE issued an Administrative Complaint and Penalty to P.F. Summers, Inc., Bay County Enterprises, Inc. and P.F. Summers Myrtle Point L.L.C. via Eugene N. St. Clair, Resident Agent for sediment control, sediment pollution and water pollution violations that occurred during the development of the Wood at Myrtle Point Subdivision in St. Mary’s County. The Administrative Complaint includes the assessment of a $60,000 penalty. P.F. Summers, Inc., Bay County Enterprises, Inc. and P.F. Summers Myrtle Point L.L.C. have the right to appeal the penalty assessment.
