BALTIMORE, MD (January 3, 2008) – The Maryland Department of the Environment (MDE) Water Management Administration Compliance Program issued the following enforcement actions between November 1 and December 31, 2007:

Tracy DeMarr, Charles County,
SCO-08-0658, December 19, 2007. The Compliance Program issued a Site Complaint and Order (SCO-08-0658) for filling a waterway and floodplain by disposing of solid waste into a ravine. The property owner has been ordered to remove the solid waste from the waterway and floodplain. MDE’s Waste Management Administration (WMA) was also on site during the issuance of the Site Complaint and Order (SCO). WMA/Compliance will monitor the removal activities until the SCO is satisfied.

B&W Marine Construction, Inc., Anne Arundel County,
SA-08-063, December 14, 2007. A Settlement Agreement was executed on December 14, 2007 in final resolution of violations of Title 16 that occurred at 314 S. Riverside Dr., Crownsville. The Department penalized the contractor $5,000 for constructing a replacement bulkhead in tidal waters without authorization.

Mark Donze and Laurie Donze, Anne Arundel County,
SA-08-0632, November 28, 2007. A Settlement Agreement was executed on November 28, 2007 in final resolution of violations of Title 16 that occurred at 314 S. Riverside Dr., Crownsville. The Department penalized the property owners $2,500 for constructing a replacement bulkhead in tidal waters without authorization and it was agreed that a stone revetment would be placed in front of the replacement bulkhead per the agreement.
Francis O. Day Co., Inc., Laurel Sand and Gravel/Annapolis Junction, Anne Arundel County,
C-08-067, November 20, 2007. Payment of $9,500, payable to the Sediment Control Fund, was received. This settled the sediment control violations. Specifically, the approved erosion and sediment controls failed to be implemented and maintained causing sediment to discharge to Waters of the State.

K. Hovnanian Companies of Maryland, Inc., The Paddocks Subdivision, Anne Arundel County,
C-08-0621, November 20, 2007. Payment of $10,000, payable to the Sediment Control Fund, was received. This settled the sediment control violations. Specifically, the approved erosion and sediment controls had failed to be implemented and maintained causing sediment to discharge to Waters of the State.

Wayne Hilmer, Queen Anne’s County,
SC-O-08-0635, November 8, 2007. The Compliance Program issued a site complaint and order. The site complaint was for the failure of Mr. Hilmer to obtain a tidal wetlands license. It was observed that Mr. Hilmer has placed a stone revetment along with a stone groin in waters of the Chesapeake Bay. In addition a wooden platform was installed adjacent to the stone revetment. All of the above were constructed without a tidal wetlands license. The Order required that all unauthorized stone and the timber platform be removed and a restoration plan be submitted to MDE for review. On November 9, 2007 Mr. Hilmer requested a hearing on the site complaint and order.

South Carroll Swim Club, Inc., Carroll County,
AO-08-0622, November 6, 2007. MDE issued an administrative Complaint, Order and Penalty against the South Carroll Swim Club, Inc.(SCSC) for alleged discharge permit and water pollution violations pertaining to operations of its subsurface wastewater treatment system for domestic wastewater from bathroom, shower and kitchen facilities and its 172,000 gallon swimming pool. The Order requires that SCSC continue to have all domestic wastewater hauled offsite for proper treatment and disposal until such time that the treatment system is operating as designed and to submit to MDE within 30 days, for review and approval, a time schedule for the evaluation and testing of its subsurface treatment system and a corrective action plan for the repair or upgrade the treatment system to correct any leaks to groundwater or operational malfunctions. The Order also requires that SCSC comply with the monitoring and reporting requirements of the facility’s General Discharge Permit for Swimming Pools. MDE is seeking a penalty of $33,500 to be paid to the Maryland Clean Water Fund.
