 New! Request for Comments Regarding Harvest RGI, LLC. Application for Individual Composting Facility Permit Application – 2016-ICF- 0001

Harvest RGI, LLC., 7800 Kabik Court, Woodbine, MD 21797 submitted an application to the Department for a new Individual Composting Facility Permit (ICFP) for its ongoing operation of composting yard waste and wood waste.

The facility is a 36-acre organics recycling facility located at 7800 Kabik Court, in Woodbine, Carroll County. The facility has a capacity to accept 200,000 cubic yards of yard waste/wood waste per year and produce approximately 120,000 cubic yards of compost per year. The Department determined the ICFP application was complete on February 10, 2017.

Per Code of Maryland Regulations 26.04.11.10F, the Department is opening the Harvest’s ICFP application to public comments for 30 days. Comments must be received by the Department no later than March 31, 2017. Comments should be forwarded to the Maryland Department of the Environment, Land Management Administration, Resource Management Program, Waste Diversion Division, 1800 Washington Blvd., Baltimore, Maryland 21230-1708, Attn: Mr. Tariq Masood, Project Manager. A 30-day public comment period for the draft document "Total Maximum Daily Load of Sediment in the Non-Tidal South River Watershed, Anne Arundel County, Maryland" will take place from January 23, 2017 to February 21, 2017. The Maryland Department of the Environment gives notice of public hearing/comment period concerning the following proposed action: Amend Regulation .02 under COMAR 26.11.34 Low Emission Vehicle Program. The purpose of this action is to update incorporate by reference Regulation .02 to reflect the changes made by California since the last Maryland update in 2015.

Announcing the Public Comment Period for Maryland's Draft 2016 Integrated Report of Surface Water Quality!

The Maryland Department of the Environment (MDE) is announcing the availability of the Draft 2016 Integrated Report (IR) for public review and comment. The public review period will run from December 23, 2016 to January 23, 2017. The Department is hosting an informational public meeting and conference call in Baltimore at 6pm on January 9, 2017. For more information about the public meeting and to access the draft documents please see the 2016 Draft Integrated Report page.

Notice of Public Hearing Concerning the State’s intention to Request Full Delegation of Authority to Implement the “Federal Plan Requirements for Sewage Sludge Incinerators (SSI) Constructed On or Before October 14, 2010” from EPA

The Federal Plan was promulgated by EPA in accordance with the requirements of Sections 111(d) and 129 of the Clean Air Act. The delegation request shall include demonstration that MDE has adequate resources and legal authority to administer and enforce the SSI Federal Plan promulgated on April 29, 2016 and effective on May 31, 2016. The submittal shall include an emissions inventory of existing affected facilities in Maryland. The public hearing certification, including notice published in the Maryland Register concerning the proposed delegation request and the public hearing transcript shall also be provided. A Memorandum of Agreement shall be developed with EPA Region III upon submittal of this delegation request.

The public hearing will be held on December 14, 2016, from 10 a.m. to 11 a.m. at the Department of the Environment, 1800 Washington Boulevard, 1st Floor Conference Rooms, Baltimore, Maryland 21230-1720. Notice of public comment period on State of Maryland Regional Haze Implementation Plan Revision Alternative BART for the Verso Luke Paper Mill

The Maryland Department of the Environment (MDE) gives notice of a public hearing and comment period regarding a State Implementation Plan (SIP) revision to the Maryland Regional Haze State Implementation Plan (SIP) that was approved in June 13, 2012.  This SIP revision seeks an alternative best available retrofit technology (BART) strategy and emissions limits at the Verso Luke Paper Mill.

The public hearing will be held on November 3, 2016 at 10:00 A.M. at the Maryland Department of the Environment headquarters located at 1800 Washington Boulevard, First Floor Conference Room, Baltimore, Maryland, 21230.

Notice of public comment period to amend regulations .02, .03, and .04 under COMAR 26.12.03 State Radiation Control Fund.

The Maryland Department of the Environment gives notice of public comment period concerning the following proposed action: Amend regulations .02, .03, and .04 under COMAR 26.12.03 State Radiation Control Fund.  The purpose of this action is to adopt into regulation a revision to § 8-301 of the Environment Article to include fee exemption for temporary pro bono dental clinics; and to reduce the annual registration or licensing fee for general radioactive material licenses, veterinary dental radiation machines, and portable lead paint analyzers.

The Maryland Department of the Environment gives notice of public hearing/comment period concerning the following proposed action: Amend Regulation .17 under COMAR 26.11.02 Permits, Approvals, and Registration. The purpose of this action is to reduce the permit to construct application fee for charbroilers and pit barbecues, and small fuel burning equipment with a rated heat input capacity of less than 10 million Btu per hour (10 MMBtu/hr).

The Stadium Square II Property located in Baltimore, Maryland 21230 has been accepted into Maryland’s Voluntary Cleanup Program. A proposed response action plan (RAP) has been submitted to the Maryland Department of the Environment (MDE) for approval. The RAP proposes an environmental containment remedy and implementation of a groundwater use restriction to address metals, pesticides, polycyclic aromatic hydrocarbons and total petroleum hydrocarbons in soil, and mercury and volatile organic compounds in soil gas at the Site. This RAP is based upon future use of the property for residential purposes.

A proposed response action plan (RAP) has been submitted to the Maryland Department of the Environment (MDE) for approval. The RAP proposes an environmental containment remedy and implementation of a groundwater use restriction to address metals and polycyclic aromatic hydrocarbons in soil, and volatile organic compounds in soil gas at the Site. This RAP is based upon future use of the property for commercial purposes.

Notice of Public Hearing on the Consent Agreement and “NOx Averaging Plan” for Raven Power, a Revision to Maryland’s State Implementation Plan

The Maryland Department of the Environment (MDE) will hold a public hearing reviewing the 2016 Consent Agreement with the “NOx Averaging Plan” between the Department and Raven Power Fort Smallwood, LLC which is proposed as a State Implementation Plan (SIP) revision.  This Consent Agreement will replace the existing Consent Order dated April 16, 2001 (with Maryland SIP #01-05) and the Consent Order dated October 24, 2012.

The public hearing will be held on May 19, 2016 at 9:00 A.M. in the Maryland Department of the Environment headquarters located at 1800 Washington Boulevard, First Floor Conference Room, Baltimore, Maryland, 21230. The public hearing will be held as required by federal law under the Clean Air Act. After consideration of comments received, the SIP will be finalized and submitted to the United States Environmental Protection Agency for approval.

Repeal and amend COMAR to reflect changes to 40 CFR 97 Subparts AAAAA – CCCCC.  The purpose of this action is to remove references to an expired federal program (CAIR), and direct affected sources, and certain sources which can use NOx ozone season allowances as an alternative method to achieve compliance, to the current federal emission trading program located in 40 CFR 97 Subparts AAAAA – CCCCC.  This action amends the definition of “NOx Ozone Season Allowance” to reference the current federal trading program. This action also modifies text in COMAR 26.11.14.07C & D

  • Repeal Chapter COMAR 26.11.28 Clean Air Interstate Rule (CAIR) program, all Regulations .01 - .08.
  • Amend definition of COMAR 26.11.01.01B(24-1);
  • Amend COMAR 26.11.14.07C(1) by removing reference to COMAR 26.11.28; and
  • Amend COMAR 26.11.14.07D(1)(a) by removing the word “certified”.

  Notice of Public Hearing on the Maryland State Implementation Plan for Clean Air Act Section 128 for all National Ambient Air Quality Standards

The Maryland Department of the Environment (MDE) will hold a public hearing on a State Implementation Plan (SIP) addressing Clean Air Act Section 128 requirements for all National Ambient Air Quality Standards (NAAQS) for the disclosure of potential conflicts of interest by State boards and agency heads that approve permits or enforcement orders.  The U.S. Environmental Protection Agency (EPA) sets NAAQS for six principal air pollutants known as “criteria” pollutants: carbon monoxide, lead, nitrogen dioxide, ozone, particulate matter, and sulfur dioxide.

The public hearing will be held on February 1, 2016 at 11:00 A.M. in the Maryland Department of the Environment headquarters located at 1800 Washington Boulevard, First Floor Conference Room, Baltimore, Maryland, 21230.
The public hearing will be held as required by federal law (Clean Air Act at 42 U.S.C. 7410 (a) and 40 CFR 51.102).
After consideration of comments received, the plan will be finalized and submitted to the United States Environmental Protection Agency for approval.

Amendments to Regulations .01 & .10 under COMAR 26.11.01 General Administrative Provisions and Regulations .01, .04, .07 & .08 under COMAR 26.11.08 Control of Incinerators to clarify requirements for incinerators and Portland cement plants that demonstrate compliance with visible emissions (VE) standards through use of continuous opacity monitors (COMS), and delete the applicability of the Department’s Technical Memorandum 90-01 (TM) for incinerators equipped with COMS. In addition, the amendments will exempt incinerators that are 1) owned or operated by a government entity and 2) used solely to destroy illegal or prohibited goods from COMAR 26.11.08 requirements.

The Maryland Department of the Environment gives notice of public hearing/comment period concerning the following proposed action:

Amendments to Regulations .01, .01-1, .02, .03, .04, and .07 new Regulation .03-1 under COMAR 26.11.24 Vapor Recovery at Gasoline Dispensing Facilities. The primary purpose of this action is to allow new gasoline dispensing facilities (GDFs) and GDFs undergoing major modifications the option to choose not to install or decommission existing Stage II vapor recovery equipment. Existing GDFs may decommission Stage II vapor recovery equipment after October 1, 2016.

This action will be submitted to the U.S. Environmental Protection Agency (EPA) for approval as part of Maryland's State Implementation Plan (SIP).

The public hearing will also cover the Department’s 110(l) demonstration to EPA. The 110(l) refers to the Clean Air Act requirement under section 110 titled “State implementation plans for national primary and secondary ambient air quality standards” and section (l) titled “Plan Revisions”. The Department’s 110(l) demonstration details how decommissioning of Stage II vapor recovery requirements in Maryland will not interfere with ozone attainment requirements of the Clean Air Act.

The Maryland Department of the Environment gives notice of public hearing/comment period concerning the following proposed action:

Amendments to Regulation .26 and new Regulation .26-1 under COMAR 26.11.19 Volatile Organic Compounds from Specific Processes to adopt new volatile organic compound (VOC) limits, standards for application methods, and work practice requirements which are consistent with the most recent EPA Control Techniques Guidelines (CTG) recommendations applicable to fiberglass boat manufacturing. The new Regulation .26-1 affects manufacturers of fiberglass boats. COMAR 26.11.19.26 Control of Volatile Organic Compounds from Reinforced Plastic Manufacturing is amended to exempt fiberglass boat manufacturing.

Adopt new Regulations .01 — .08 under a new chapter, COMAR 26.11.30 Control of Portland Cement Manufacturing Plants to create a separate chapter applicable to Portland Cement Manufacturing Plants containing requirements unique to them. The new chapter combines existing requirements in COMAR 26.11.01, .06, and .29 regarding NOx, SOx, visible emissions, and particulate matter that apply to Portland cement manufacturing plants into one chapter.

The regulatory actions listed above will be submitted to the U.S. EPA for approval as revisions to Maryland's State Implementation Plan.

The purpose of this action is to amend regulations COMAR 26.09, Maryland CO2 Budget Trading Program, with program improvements developed in conjunction with other participating states during the 2012 Comprehensive Region Greenhouse Gas Initiative (RGGI) Program Review. This proposed action includes the following revisions:

1. A reduction in the Maryland CO2 emissions budget;
2. Adjustments to the emissions budget through 2020 to offset the large private bank of allowances to ensure a binding cap;
3. Adoption of a new mechanism, the Cost Containment Reserve (CCR), to reduce price volatility in the allowance market;
4. The addition of an interim compliance period;
5. The addition of new “minimum reserve price” and “long term contract price” definitions;
6. Replacement of the existing afforestation offset protocol with a new, more inclusive, forest offset protocol;
7. Revisions to other definitions.

On February 1, 2012 (effective March 2, 2012) EPA reclassified the Baltimore, Maryland Nonattainment Area as a "serious" nonattainment area. As a serious nonattainment area for 8-hour ozone National Ambient Air Quality Standard (NAAQS), the Baltimore region is required to meet the requirements defined in the Clean Air Act, Section 182 (d) and to submit a revised serious area SIP by September 30, 2012.

The Serious Area Attainment Plan describes the progress being made to improve air quality in the Baltimore Nonattainment Area and the efforts underway to assure that all necessary steps are taken to reach the federal health standard for ground-level ozone by 2012. The plan has been prepared by the Maryland Department of the Environment Air and Radiation Management Administration to comply with the Clean Air Act Amendments of 1990 (CAAA) and with EPA requirements for the Baltimore region as stated in EPA’s reclassification of the Baltimore region (77 Fed. Reg. 4901, February 1, 2012).

The Maryland Department of the Environment (MDE) will hold a public hearing on a State Implementation Plan (SIP) addressing the 1997 PM25 NAAQS national ambient air quality standard for fine particulate matter.  Due to the improvement of PM2.5 air quality, the Washington DC-MD-VA nonattainment area is currently operating under a clean data determination (74 FR, 1146, 1/12/2009).  Maryland proposes that USEPA redesignate the area to attainment for the PM2.5 standard as well as concurrently approve the maintenance pan for PM2.5

In accordance with §1-604 of the Environment Article, Annotated Code of Maryland, notice is given that the Land Management Administration has made Tentative Determination to reissue the following State and National Pollution Discharge Elimination System (NPDES) General Discharge Permits: MDG34 for the Discharges of Storm Water and Hydrostatic Test Water From Oil Terminals and MDG91 for the  Discharges of Treated Ground Water from Oil Contaminated Ground Water Sources.  Similar permits have been authorized for these discharge classes on a 5 year cycle since 1997.

General Permit for Discharges of Storm Water and Hydrostatic Test Water From Oil Terminals (MDG34) - This permit authorizes the discharge of storm water from storage tank diked and loading rack areas and  hydrostatic test water to surface or ground waters of the State from petroleum terminals having less than 5,000,000 gallons storage of oil.  This permit sets numerical limits on the concentration of the petroleum product contamination following treatment of the storm water or hydrostatic test water.

General Permit for Discharges of Treated Ground Water from Oil Contaminated Ground Water Sources (MDG91) - This permit authorizes the discharges of treated ground water previously contaminated by petroleum products as the result of leaks or spills.  This permit sets numerical limits on the effluent concentration of the petroleum product contamination following treatment of the contaminated ground water. 

Both federal (40 CFR 122) and State (COMAR 26.08.04) regulations require discharge permits for these activities.  Specifically, State regulations require that discharges of any wastes or wastewater to surface or ground water, regardless of volume, be authorized by a discharge permit.  Federal regulations address discharges to surface waters only, requiring a permit for the discharge of pollutants.  The limits for these permits are based on what has been demonstrated to be technologically achievable.  Self-monitoring is required to verify compliance.  The permits also require testing to verify that the discharges with a specified volume and duration be tested to verify that the effluent is not toxic to aquatic life, and if toxicity is present, the permit requires its elimination.  This is a requirement of the federal Clean Water Act.  This permit also sets operational requirements, such as inspection routines.

 Notice of Public Hearing on Implementation, Maintenance, and Enforcement Measures for the 8-Hour Ozone National Ambient Air Quality Standard State Implementation Plan

The Maryland Department of the Environment (MDE) will hold a public hearing on a State Implementation Plan (SIP) addressing implementation, maintenance, and enforcement measures for the 2008 75 ppb 8-hour ozone national ambient air quality standard.

The public hearing will be held on December 21, 2012 at 10 a.m. in the Maryland Department of the Environment headquarters located at 1800 Washington Boulevard, Aeris First Floor Conference Room, Baltimore, Maryland, 21230.

The public hearing will be held as required by federal law (Clean Air Act at 42 U.S.C. 7410 (a) and 40 CFR 51.102).

After consideration of comments received, the plan will be finalized and submitted to the United State Environmental Protection Agency for approval.

The Maryland Department of the Environment (MDE) gives notice of a Public Hearing concerning the revised 110 (a) (2) infrastructure SIP for the 2008 lead (Pb) national ambient air quality standard.

A public hearing will be held on December 5, 2012, at the Department of the Environment, 1800 Washington Boulevard, Baltimore, Maryland 21230 – First Floor Conference Room – 10:00 AM

The Maryland Department of the Environment (MDE) will hold a public hearing, on the above State Implementation Plan (SIP) addressing implementation, maintenance, and enforcement measures for the lead (Pb) national ambient air quality standard.

The public hearing will be held as required by federal law (Clean Air Act at 42 U.S.C. 7410 (a) and 40 CFR 51.102). After consideration of comments received, the plans will be finalized and submitted to the United States Environmental Protection Agency (EPA) to revise the State Implementation Plan required by the Clean Air Act.
